Teachley, LLC (hereafter referred to as “Teachley,” “we” or “us”) is an education company dedicated to supporting positive teaching and learning experiences. We created this Privacy Policy to give you confidence in our commitment to protecting your Personal Information as you make use of www.teachley.com (the “Site”) and our related products and services, including web and mobile applications, the Teachley Connect platform, and any other online or offline offerings (collectively, the “Services”). Unless otherwise defined herein, all capitalized terms in this Privacy Policy shall have the meanings indicated in the Terms of Service. 

PLEASE READ THIS PRIVACY POLICY CAREFULLY. BY UTILIZING THE SITE OR ANY OF THE SERVICES AND/OR BY REGISTERING WITH US, YOU SIGNIFY THAT YOU AGREE TO THIS PRIVACY POLICY, INCLUDING TO OUR TERMS OF SERVICE.

1. Personal Information Collected 

Teachley collects Personal Information from individuals and education institutions that visit our Site, indicate interest in using our Services, and/or initiate or access an account to use our Services. We may obtain your information in one or more of the following ways: 

  1. You signed up to access or learn more about the Teachley Services.

  2. You logged into an account to access the Teachley Services. 

  3. An Education Institution shared your information when inquiring about or activating the Teachley Services. 

  4. You used a third-party service (e.g., Clever, ClassLink, Google) to access the Teachley Services. 

  5. You visited the Teachley marketing website.   

1a) Account information. When creating and/or maintaining an account, you or your Education Institution may be asked to provide your first and last name, valid email address, job title, grade level(s), school/district, classroom name. This information is used to activate and access an account, to receive information about your account, including but not limited to training, professional, and customer/technical support, additional Services, new features, and website and policies updates.  

Children are not permitted to create an account on their own. The Account Holder and/or Education Institution will be asked to provide information (directly to Teachley or shared with Teachley via third-party rostering services such as Clever, ClassLink, or Google) in order to allow children to access the Services. Information requested may include:

- first and last name or initial.

- unique identifier: this is optional and used to allow Teachley to maintain a child’s progress and performance data over time and to transfer a student from one teacher to another, as requested by the Education Institution.  

- username or school email and password: this is needed for the child to access the Services by logging into applications or the student dashboard. We never email students knowingly. 

- Classroom, grade level, school, a classroom and individual profile picture (optional - this allows the Account Holder to personalize the classroom selection menu and child’s avatar). 

1b) Age verification. To access some sections of the Services, you may be asked to provide your year of birth. This information is used to confirm you are permitted to access content not intended for children (e.g., web links to external sites or social media channels). This information is not saved. No areas of the Site and Services intended for children under 13 contain in-app purchasing, advertising, or links to any Social Network other Third Party Sites.

1c) Device information. We collect information from and about the computers, phones, and other web-connected devices you use. Information that we collect when you visit our Site may include: (1) IP addresses; (2) domain servers; (3) types of computers accessing the Site; (4) types of web browsers used to access the Site; (5) referring Uniform Resource Locator (“URL”) which may have sent you to the Site; (6) URL of the site you navigate to directly after leaving our Site; and (6) other information associated with the interaction of your browser and the Site, such as pages viewed, time spent on each page, Services accessed, dates (collectively, “Traffic Data”).  

A variety of technologies are used to obtain Usage and Traffic Data, including:

(i) Cookies. Cookies are small data files stored on your computer.  They contain information such as your username, user preferences, the pages you’ve visited and the activities you’ve performed while using the Site and Services. Cookies enable us to recognize your browser on return visits to our Site and to remember your preferences.  You may disable or block cookies or set your browser to alert you when cookies are being sent to your device; however, by disabling cookies, you may not have access to all of the features of the Site or Services. (ii) Web Beacons/Pixel Tags. We or our third party tracking utility companies may also use “web beacons” or “pixel tags” to collect anonymous information about your use of our Site and other third party service providers, and your use of emails, special promotions or newsletters we or selected partners may send to you. Web beacons and pixel tags are tiny graphic image files embedded in a web page or email that create a record of a user’s interaction with the web page or email and send back that record to a home server. The information collected by web beacons and pixel tags allows us to statistically monitor how many people are using our Site and selected partners’ websites and for what purposes as well as email interaction.

Certain third-party entities that we use to provide website functionality or social networking within adult-directed sections of our Site and Services  may collect Usage Information for the purposes of online behavior advertising. Our website does not respond to “do not track” signals transmitted by web browsers, but we encourage you to visit the following links if you would like to opt out of online behavioral advertising: http://www.networkadvertising.org/choices  or http://www.aboutads.info/choices/.

We use third parties, including Google Analytics, to help us collect and understand Usage Data. If you do not or no longer want to allow third parties to place cookies on your browser, many of them offer ways to opt out. To learn more about browser cookies, including how to manage or delete them, refer to the “Tools,” “Help,” or similar section of your browser. To learn more about Google Analytics, visit their privacy policy. You may opt out of Google Analytics by downloading their browser add-on, available at https://tools.google.com/dlpage/gaoptout. Note that we are not responsible for their opt-out tool.


1d) Credit Card Information. Individuals purchasing Teachley Services may be asked for a first and last name, valid email address, billing address, mailing address (needed if purchasing physical materials), phone number (optional), company (optional), credit card number, name on card, expiration date, and security code, when completing a credit card purchase through our payment processors (e.g., Stripe, Shopify, Quickbooks).

1e) Information collected from children. We collect and store learning performance data on databases locally and in our servers on Amazon Web Services as students access the Services. This information is used to update the progress charts within the applications, adjust the personalized learning experience accordingly for individual children, and to generate resources, such as certificates of achievement, saved (in process) and submitted student work, and progress monitoring reports for premium Account Holders. We do not knowingly collect personally identifiable information (“Personal Information”), such as name, phone number, age, address or email from children under the age of 13 via the Site or Services. 2.  Compliance with FERPA and COPPA

The Family Educational Rights and Privacy Act (“FERPA”). If you are an Education Institution or individual with the authority to share Student Data from education records, then you designate Teachley as a “School Official” (as defined by FERPA and its regulations) acting on behalf of the school in regards to the use and maintenance of Student Data subject to FERPA. Student Data includes student account information collected during account creation and information collected by students while using the Services as described above.  Teachley does not own Student Data and agrees to comply with FERPA. 

Children’s Online Privacy Protection Act (“COPPA”).  COPPA protects personal information of children under the age of 13. Sections 1a and 1e describe the personal information collected about and by children under the age of 13, how it is collected, and the purpose(s) of collecting the information. We request only the information reasonably needed to use the Services. If you are a parent Account Holder, you consent to Teachley collecting, using, or disclosing personal information from children under 13 as outlined in this policy. If you are an Education Institution or individual with the authority to share Student Data from education records, you agree you have parental consent for Teachley to collect, use, or disclose personal information from children under 13 as outlined in this policy and as permitted by COPPA. Teachley uses and processes personal information only for the purpose of providing Services to the Account Holder and deletes students’ personal information collected within a reasonable amount of time, six months, following termination of Services. Parents and Education Institutions may request to review and delete personal information collected at any time. Parents of children whose personal information was shared with Teachley by an Education Institution will be asked to contact the Education Institution directly.  Teachley will comply with written requests of Account Holders within 30 days.  Teachley does not advertise to children under the age of 13. 

3. Your Personal Data Rights 

An Account Holder may request to update and/or delete any or all of your Personal Information by contacting us at: info@teachley.com. Please indicate your name and email address, and the specific information you would like to update or delete when you contact us. You can also update your information at any time by logging directly into your account. If you are a Parent/Guardian of a child who is using the Services under an Education Institution account, please contact your Education Institution to request to review, update, and/or delete your child’s Personal Information. 

4. Third Parties 

We will not sell, rent, or trade Personal Information.  Teachley engages with third parties and subprocessors to help us do business, such as store our services and data, provide customer support, and process credit card payments. Third Parties will only be provided with the limited information that they need to perform their business function. They will only use your Personal Information to carry out their specific business obligations and to help us provide and continuously improve the Site and related Services. The Site and Services may contain hyperlinks to social network and other third party sites in areas intended for adults.  These links are included for your information and convenience only, and does not suggest an endorsement by Teachley.  These sites have their own privacy policies and we encourage you to read them.

Some applications available to Account Holders may have been developed by third party app developers (“Teachley-connected app”). No Teachley-connected app receives Personal Information from Teachley and all Teachley-connected app developers are contractually obligated to comply with Teachley privacy and security policies.

We may transfer information about you to another company in connection with a merger, sale or acquisition by or of Teachley. In this event, we will use reasonable efforts to notify you before information about you is transferred or becomes subject to a different privacy policy. Account Holders may request their data be deleted and not transferred. 

We reserve the right to disclose your Personal Information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on our Site and/or to protect the rights, property or safety of a third party.

5. Security 

Teachley shall maintain the following technical, physical, and administrative safeguards and practices to protect Personal Information, which align with the NIST Cybersecurity Framework, including:

a. Technical Safeguards. 

(i) Encryption: We use commercially reasonable encryption technologies with respect to the receipt and transfer of Personal Information submitted to Teachley, including using Secure Socket Layer (“SSL”) technology. All student data is encrypted in transit and at rest. 

(ii) Access Controls: Access to data is role-based and requires background clearance, training, and unique credentials. 

(iii) Network Security: Firewalls, intrusion detection, and logging mechanisms are implemented.

b. Physical Safeguards. Data is stored on a secure, password-protected server, located within the United States and operated by industry-leading partners (e.g., Amazon Web Services). Only authorized personnel are granted permission to access the information. Accordingly, if you are located outside of the United States, Personal Information you provide to us will be transferred to the United States. By submitting your Personal Information, you consent to its transfer and storage in the United States and its use in accordance with United States law and the purposes for which it was originally collected. 

c. Administrative Safeguards. All employees with access to Personal Information are required to complete confidentiality agreements, background clearance, and training on FERPA, Ed Law §2-d, COPPA, and internal privacy protocols prior to being granted access. Subcontractors and independent consultants will be required to demonstrate compliance with these same safeguards in a contracting agreement prior to receiving access to Personal Information.  

6. Personal Data Retention 

Upon expiration or termination of contracted services, Teachley will delete the account in its possession within six months following the event or as otherwise requested by the contracted Education Institution or Account Holder except when required to maintain the information for legal or compliance purposes. Requests for the review, return, correction, and/or deletion of student data can be made at any time, a request that will be completed within 30 calendar days or as otherwise outlined in contractual agreements. Parents of children accessing the Site or Services through their Education Institution should contact the Education Institution with requests.  In the event an account has been inactive (not accessed by the Account Holder within 13 consecutive months), then Teachley reserves the right to delete the account. Teachley may attempt to contact the Account Holder by email prior to deleting the account.       

7. Changes to this Privacy Policy

We reserve the right, at any time, to add to, change, update, or modify this Privacy Policy so please review it frequently. If we do, then we will notify current Account Holders here, as well as by posting a notice on our Site and/or by emailing you, requesting that you opt-in for material changes or providing other notice as required by law. Should we make material changes to this Privacy Policy, we shall notify Account Holders of the Services and request consent prior to implementing the changes. In all cases, our use of Personal Information we collect is subject to the Privacy Policy in effect at the time such information is collected.

8. Your California Privacy Rights 

Under California law, users who are residents of California may contact us and request certain information about our disclosure of Personal Information to third parties for their direct marketing purposes during the prior calendar year. California residents may request such information by contacting us at the address listed at the end of this Privacy Policy.
